The Sahrawi Association for the Defense of Human Rights (ASADEDH) has announced its intention to appeal to the Constitutional Court to challenge the Spanish Supreme Court’s decision regarding its complaint against the leader of the Polisario Front, Ibrahim Ghali, who is accused of crimes against humanity.
The Sahrawi Association stated that it had observed numerous irregularities since the beginning of the investigation into its complaint against Ghali. He is accused of committing serious crimes against humanity, including genocide, murder, injury, illegal detention, terrorism, torture, and enforced disappearance. According to international law and the United Nations Charter, these crimes are considered crimes against peace and international security.
Since 2007, former National Court judge in Madrid, Baltasar Garzón, has been leading the investigation into this case. However, the association was surprised this year, 2024, by the Spanish Supreme Court’s decision to classify the complaint as « closed » due to the statute of limitations, which the association described as unjustified.
As a result, the Sahrawi Association decided to appeal this decision before the Constitutional Court. The association affirmed its full confidence in the Spanish judicial system and expressed hope that this appeal would lead to the accountability of all those responsible for the crimes committed against Sahrawis in the Tindouf camps in Algeria, ensuring that no Polisario Front official escapes justice.
The hope remains that the Spanish judiciary will achieve justice, redress the victims of crimes against humanity, and ensure that those responsible are held accountable and do not escape punishment.
